Terms of use
These are the rules for using Raccollect. We kept them short and plain. Please read them, especially the part about what is not allowed (section 6).
1. Who we are
Raccollect is offered by Kev Amir in the Netherlands ("we", "us"). You can reach us at raccollect@gmail.com with questions, reports and complaints, also if you don't have an account. This address is also our point of contact for authorities and for the EU Digital Services Act.
2. Agreeing to these terms
When you start Raccollect, you tick that you are 16 or older and agree to these terms. By using Raccollect you accept them. Our privacy policy explains what we do with your data. If you don't agree, please don't use Raccollect.
3. Age
Raccollect is for people aged 16 and older. If we learn that a user is younger, we delete the account.
4. Your account
- You can sign in with an email address and password, or with your Google account. Keep your password to yourself. You are responsible for what happens with your account.
- You can also start as a guest, without an email address. A guest account works only on that phone: if you log out or remove the app, it's gone. Guest accounts that aren't used for 30 days are deleted.
- One person per account. Don't use someone else's account, and don't pretend to be someone else in your name or @username.
- You can delete your account at any time in the app: Settings → Delete account. This removes your profile, catches, stickers, badges and follows for good. You can also ask us by email.
5. What you share, and your responsibility
- When you catch an item, the app makes a sticker (a cut-out) from your photo. While your profile is public, other users can see your stickers, catches and badges. Your name, @username and avatar are visible to everyone who uses Raccollect. Your exact location is never shown to others.
- You are responsible for what you share: your photos and stickers, your name, @username and city, your comments and the notes in your reports. Only use photos you took yourself, and that don't break anyone's rights.
- You keep the rights to your photos and stickers. You give us a free, non-exclusive, worldwide permission to store, cut out, resize and show them in Raccollect, to you and to the people who may see them under your settings. This permission ends when you remove them or delete your account (copies in backups disappear later; see the privacy policy).
- The app, its drawings, riddles and texts, and the name Raccollect are ours. You may use them in the app and when you share your own stickers and share cards.
6. Zero tolerance: what is not allowed
We have zero tolerance for objectionable content and abusive users. Don't post, as a photo, sticker, name, @username, comment or report note:
- nudity or sexual content;
- violence, gore, or animals being hurt, tortured or killed;
- hate or discrimination against people or groups;
- harassment, bullying, threats or stalking, also through follows, likes or comments;
- photos in which people can be recognised without their permission, or anyone's personal data;
- illegal content, or content that encourages illegal acts (for example disturbing or catching protected animals);
- spam, advertising, or pretending to be someone else;
- content that breaks someone's copyright or other rights.
Don't misuse Raccollect either: no bots or scripts, no attempts to get around our limits or security, no reports you know are false, and no attempts to read data that isn't meant for you.
7. Report and block
- Report: you can report a user (on their profile, tap the ⋯ menu and choose Report), a catch in your feed, or a comment. Pick a reason and add a note if you like. The person you report is not told who reported them.
- Block: on someone's profile, choose Block in the same menu. You no longer see each other's catches, badges or activity, and you stop following each other. They are not told. You can unblock in Settings → Privacy → Blocked users.
- Anyone, also without an account, can report content to raccollect@gmail.com. Please tell us the @username and what is wrong.
8. What we do
- We review reports and aim to do so within 24 hours. When content breaks these terms, we remove it and can suspend or delete the account that posted it. In serious cases we do this without a warning.
- We may also remove content or suspend an account on our own initiative, for example when identification marks a photo as unsafe. We may report illegal content to the authorities.
- When we remove your content or suspend your account, we tell you why by email if we have your email address, and you can reply to object. We look at your reply again with fresh eyes. You can always go to court too.
- We don't check every sticker or comment before others see it.
9. Identification is automatic and can be wrong
Raccollect tells you automatically what a photo shows, using an AI service (see the privacy policy). The answer can be wrong. Don't rely on it for anything that matters for safety or health: whether an animal or plant is dangerous or poisonous, whether you can touch, feed or eat something, or whether a species is protected.
Identification needs an internet connection, and we limit how many photos can be checked per day; the app shows when you reach the limit. Keep your distance from wild animals, follow the rules of nature areas, respect private property and other people's privacy, and never disturb nests or protected animals for a photo.
10. The service, without guarantees
Raccollect is free and offered "as is". We do our best to keep it running and your data safe, but we don't promise that Raccollect is always available or free of errors, or that your catches can never be lost. We may change, pause or stop features, or stop Raccollect altogether. If we stop Raccollect, we'll tell you in the app at least 30 days before, where we can.
If we ever add paid features, we'll show you the price and conditions before you pay.
11. Liability
As far as the law allows, we are not liable for indirect damage, or for damage caused by relying on an identification or by content of other users. Our total liability to you is limited to EUR 100. This does not limit liability that the law doesn't allow us to limit, such as for intent or gross negligence, and it doesn't take away your rights as a consumer.
12. Changes to these terms
We may change these terms when Raccollect changes or the law requires it. We announce important changes in the app at least 30 days before they apply. If you don't agree, you can delete your account before then.
13. Law and disputes
Dutch law applies to these terms. If you are a consumer, you keep the protection that the mandatory law of your country of residence gives you. Disputes go to the competent court in the Netherlands, unless the law lets you, as a consumer, go to the court where you live. Please contact us first: most problems are solved faster that way.
14. App stores
These terms are between you and us, not Apple or Google. Apple and Google are not responsible for Raccollect or its content, and don't have to provide support for it. The terms of the store you downloaded Raccollect from also apply.
